Music and Rights Clearance: Questions to Ask Before You Lock Picture
Asking the right questions early can prevent painful changes after a film is finished.
Treat every piece of music as borrowed until proven otherwise. A song you love, a tune you hummed, and a clip from a video you found online may all belong to someone. Assume you need permission and then check.
Ask who owns what. A recording and the song it performs can have different owners. Original music may belong to the composer unless you have a written agreement. Settle this before work starts.
Get agreements in writing. For original music, performers, actors, locations and artwork, write down who agreed to what, for which uses, and for how long. A simple, clear document signed by everyone is better than a verbal "sure."
Read the licence for stock and free music. Some licences allow festival screenings but not online release, or require credit. Save a copy of the terms along with the date you downloaded.
Think about people on screen. Faces, voices and private property may need releases. For participants under the age of majority, a parent or guardian generally must be involved. Check local requirements.
Mind logos and artwork in the background. Posters, brand names, murals and toys can raise questions. Frame them out or ask. Keep a clearance sheet. List every element, its source, the person who gave permission, the date, and where the paperwork is stored.
Follow each festival's rules. Some ask you to confirm you hold rights; others ask for a music cue sheet. Read the submission terms carefully. Ask a professional. Rules vary by place, and this is general guidance. If anything feels uncertain, consult an entertainment lawyer or a trusted advisor before you share the film publicly.
